ORDER:
Heard learned Counsel for the petitioners and learned Government Pleader for respondents 1 to 4.
This Writ Petition was filed challenging the action of third respondent in not permitting the members of the society to enter into the election hall and to declare respondents 6 to 12 have been elected unanimously.
Denying the allegations made by the petitioners, respondents 2 and 3 filed a counter affidavit stating that at 11.30 a.m. all the voters were informed with regard to number of posts and in response to the same, only seven nominations were filed from 12.20 noon to 12.37 noon. It is further stated that both the petitioners have not filed nominations, however, they demanded to stop the election process and hence the election officer took the police protection and completed the election process.
There is no interim order staying the election process and hence no further orders need be passed at this length of time.
Having regard to the same, the Writ Petition is dismissed as having become infructuous.
Miscellaneous petitions pending consideration if any in the Writ Petition shall stand closed in consequence. No order as to costs.
