Heard Mr.Narendra L. Jain, learned advocate for the petitioner. It is submitted by him that the petitioner has supplied ready-made garments to the respondent Company during the financial year 2008-2010. There has been no complaint from the respondent regarding the quality of the goods. However, the respondent Company has failed to pay the outstanding amount of Rs.64,05,916/- towards sale of the goods and sales-tax liability with accrued interest at the rate of 18% per annum from 01.04.2012. It is further submitted that in spite of two statutory notices dated 01.05.2012 and 25.05.2012 under Sections 433 and 434 of the Companies Act, 1956, the respondent has not responded. Both the notices have been returned by the respondent.
