High Court Of Judicature at Allahabad|24 June, 2010

JUDGMENT / ORDER

Hon'ble Devendra Kumar Arora,J.
Heard Sri Ram Raj, learned counsel for the petitioners, learned Addl. Chief Standing Counsel appearing on behalf of opposite parties and also perused the pleadings of the writ petition.
By means of this writ petition, the petitioners have prayed for a writ in the nature of mandamus commanding the opposite party no. 2 i. e. Sub Divisional Magistrate, Barabanki to grant approval to the exchange of land under section 161 of lthe U. P. Zamidari Abolition and Land Reforms Act, 1950 due to lack of which petitioners are unable to establish Medical College to provide medical facilities to the public at large.
At this stage, learned counsel for the petitioners confines his prayer only to the extent that a direction be issued to the opposite party no. 2 to consider and dispose of the matter of approval of the restoration of gram panchayat for exchange of lands.
Learned Addl. Chief Standing Counsel has no objection for issuing direction to the opposite party no. 2 for the same.
We, therefore, considering all the aspect of the matter, dispose of this writ petition finally with the direction to the opposite party no. 2 to take an early decision on the resolution of the Land Management Committee dated 25.9.2008 expeditiously, say, within one month from the date of production of certified copy of this order.
