Order:
This Writ Petition is filed for a Mandamus to declare the action of respondent Nos.1 to 5 in not considering the petitioner’s representation, dated 24- 11-2014, to shift the proposed location of electrical transformer abutting the compound wall of his house bearing No.2-42 situated at Somireddy Bazar of Macherla Municipal Limits, Macherla Town, Guntur District, as illegal and arbitrary.
I have heard Mr.Venkat Reddy Kodumury, learned Counsel for the petitioner, and perused the record.
It is the pleaded case of the petitioner that he is the owner of the above-mentioned house and that adjacent to his house, a rice mill is established by respondent No.6. The grievance of the petitioner is that abutting the compound wall of his house, the official respondents are preparing to erect a new transformer for the benefit of respondent No.6 and that the objection raised by him vide representation, dated 24-11-2014, is not being considered by them.
The petitioner has filed two photographs, a perusal of which would show that a pedestal is raised for erection of electrical transformer abutting the compound wall of the rice mill of respondent No.6. It is also evident from the said photographs that no part of the pedestal over which the transformer is proposed to be erected affects the petitioner’s house in any manner what-so-ever. The pedestal has been erected between the existing electrical pole and the compound wall of respondent No.6. Erection of a transformer on such pedestal neither interferes with the ingress and egress to the petitioner’s house nor causes any danger to the lives of the petitioner and his family members. In this view of the matter, I do not find any reason to issue a Mandamus in favour of the petitioner.
For the above-mentioned reasons, the Writ Petition is dismissed.
As a sequel, WPMP.No.46950 of 2014, filed by the petitioner for interim relief, is disposed of as infructuous.
