The petitioner is the owner and in possession of the property comprising in Resurvey No.69/11, 69/12,69/13,69/14 and 70/8 of Block II of Kuttoor Village, Thiruvalla. Admittedly, this property is classified as nilam in the Draft Data Bank. The petitioner approached the Local Level Monitoring Committee to remove the classification of his land as nilam and also sought permission to construct a residential building. Taking note of the fact that this is a paddy land as on the date of enactment of Act 28/2008, the Local Level Monitoring Committee forwarded this application to the District Level Authorised Committee. The above application is pending before the District Level Authorised Committee. 2. In view of the fact that the application is pending before the District Level Authorised Committee, there shall be a direction to the District Level Authorisied Committee(the W.P.(c).No. 28300 of 2014 : 2 :
first respondent RDO is the convener of the District Level Committee) to take appropriate decision in the matter within four weeks from the date of receipt of a copy of this judgment, after affording an opportunity of hearing to the petitioner. If the petitioner has no land in his possession, the District Level Authorised Committee shall consider the petitioner's request positively and allow the petitioner to reclaim 10 cents of land for the purpose of construction of residential building.
The writ petition is disposed of as above.
