Heard Sri Sanjay Singh learned counsel for the petitioner, Sri Rakesh Kumar Pandey, learned counsel for the Union of India and learned Standing Counsel for the State- respondents.
The petitioner has made a representation for recognition under Section 2(a) of Chapter 14 of the Uttar Pradesh Intermediate Education Act to the respondent no. 4.
The only prayer made by learned counsel for the petitioner is that the representation for recognition by the Board under the Intermediate Education Act may be decided within a stipulated period of time.
Learned Standing Counsel as well as Sri Rakesh Kumar Pandey, learned counsel for the Union of India does not have any objection to the aforesaid prayer.
Matter is remitted to the respondent no. 4, Secretary, Madhyamik Shiksha Parishad, Allahabad.
A writ of mandamus is issued commanding the respondent no. 4 to decide the representation of the petitioner preferably within a period of four months from the date of receipt of a certified copy of this order.
It is the onerous responsibility of the respondent no. 4 to determine all credentials of the petitioner before passing any order. It has to be ensured that the petitioner strictly in letter and spirit complies with all relevant criteria required for recognition. The comprehensive enquiry may be carried out before granting recognition.
It is also clarified that this Court has not judged the merits of the claim of the petitioner or the veracity of the submissions made in the writ petition. It is for the competent authority to do so after independent application of mind upon all the relevant criteria.
The writ petition is disposed of finally.
