JUDGMENT / ORDER

Petition filed under Section 439 Cr.P.C.
2. Petitioner is the accused in Crime No.48/2014 of Kumbala Excise Range, registered for the offence punishable under Section 55(a) of the Abkari Act.
3. The allegation against the petitioner is that on 21.09.2014 at 1.15 a.m. he was found in possession of 26.01 litres of Indian Made Foreign Liquor intended for sale in the State of Karnataka only, in contravention of the provisions of the Abkari Act.
4. Heard the learned counsel for the petitioner and the learned Public Prosecutor.
5. This is a case wherein huge quantity of IMFL is B.A.No.7718 of 2014 -: 2 :-
involved, and that the same was meant for sale in the State of Karnataka only. The learned Public Prosecutor has pointed out that the petitioner is an accused in Crime No.50/2013 of the very same Excise Range for a similar offence and that he has committed the present offence while he was on bail in the other case. Having regard to the huge quantity of contraband involved in this case and the criminal antecedent on his part, I am of the view that the petitioner is not entitled to be enlarged on bail.
In the result, this Bail Application is dismissed.
