Heard. The composition is accepted and permission is granted for composition under Section 320(6) Cr.PC. Crl.R.P.No.3911 of 2009.
Conviction and sentence under Section 138 of Negotiable Instruments Act are under challenge in this revision. Pending the proceedings the parties settled the dispute amicably out of court and compounded the offence. The composition filed by the parties was accepted and permission for composition was granted on Crl.M.A.No.3239 of 2014. Accordingly, the conviction and sentence against the petitioner under Section 138 of NI Act in ST.No.650/2006 of the Judicial First Class Magistrate Court-IX, Thiruvananthapuram are set aside and the Crl.M.A.No.3237/2014 & Crl.R.P.No.3911/2009 2 petitioner/accused is released from prosecution on the benefit of acquittal under Section 320(8) Cr.PC. The bail bond executed by the petitioner will stand discharged.
This Crl.RP is allowed as above.
