JUDGMENT / ORDER

[Order of the Court was made by M.VENUGOPAL, J.] This Writ Petition has been filed seeking issuance of a Writ of Mandamus directing the respondents to construct adequate classroom buildings, science laboratory, compound wall, toilets and to provide adequate drinking water and furniture on the basis of number of students strength to the Government Higher Secondary School, Ayyankottai, Madurai District within the time stipulated by this Court.
2.Heard both sides. No counter is filed on behalf of the respondents 1 to 3.
3.By consent, the main Writ Petition itself is taken up for final disposal.
4.According to the Petitioner, he went to the Government Higher Secondary School, Ayyankottai, Madurai along with his friend Vignesh and found that the said school was started to function on 20.1.1933. He came to know that around 430 students are studying in the said school from sixth standard to twelfth standard. 226 boy students and 204 girl students are studying in the said school. In and around Ayyankottai, most of the students from socially and economically weaker sections of the society are studying in the said school. The said Government School has a building and has got only five class rooms for all sixth standard to 12th standard. It has two other rooms for non-teaching activities. The school has a separate room for Headmaster/Teachers. As a matter of fact, the school has no boundary wall. The source of drinking water in the school is tap water and it is non functional. The school has one boys' toilet and it is non-functional. But one girls' toilet is functional. The school has only two computers for teaching and learning purposes and all are functional. The school has a playground. The school is not having any computer aided learning laboratory and science laboratory. The school is lack of furniture.
5.The version of the Petitioner is that students are studying under the open sky in the Government Higher Secondary School, Ayyankottai, Madurai on the tree shadow as their roof, wall as their blackboards, bricks as chairs and tree branches on which they hang their school bags. Indeed, the school still lacks furniture, classrooms and even blackboards due to lack of concern on the part of the educational authorities and people representatives. Over 430 students of middle school, high school and higher secondary class are forced to study in the open place due to shortage of classrooms.
6.The students in and around six villages are studying in the present school namely C.Pudur, Meenakshipuram, Sempukudupudi, Nagari, Thanichayam and Risabam. In the school premises, few village peoples and unwanted peoples have wandered. Some antisocial elements trespassed into the school campus and disturb the students. Due to the absence of compound wall, at night times particularly and also in the vacation period, some antisocial elements trespassed into the school campus with liquor and other unwanted things and in the morning, they left the school leaving the empty broken liquor bottles and as such, the environment of the school is affected by these unsanitary conditions.
7.The Petitioner made a representation narrating the facts on 26.9.2017 addressed to the Respondents 1 to 3 whereby and where-under a request was made to provide necessary compound wall building, adequate furniture, more classrooms and science laboratory etc. But his representation has not seen the light of the day. Hence the Petitioner has filed the present Writ Petition praying for passing of an order by this Court in directing the respondents to construct adequate drinking water and furniture on the basis of number of students strength to the Government Higher Secondary School, Ayyankottai, Madurai District within the time stipulated by this Court.
8.At this stage, the Learned Additional Government Pleader appearing for the Respondents informs this Court that the Government has sanctioned a sum of 1.16 crores for construction of school buildings and for other infrastructure of the school.
9.As such, recording the said factum of the learned Additional Government Pleader appearing for the Respondents that the Government has sanctioned a sum of Rs.1.16 crores for construction of compound wall and for other infra-structural facilities, this Court, directs the Third Respondent to dispose of the representation of the Petitioner, dated 26.9.20176 appraising him of the amount of Rs.1.16 crores sanctioned in respect of the school for providing compound wall and other infra-structural facilities etc., within a period of three weeks from the date of receipt of a copy of this order.
10.With the above said observation(s) and direction(s), the Writ Petition stands disposed of. No costs.
