Court No. - 44
Case :- CRIMINAL MISC. WRIT PETITION No. - 5245 of 2021 Petitioner :- Bittu @ Ayush Upadhyay Respondent :- State Of U.P. And 2 Others Counsel for Petitioner :- Ramesh Chandra Upadhyay,Ghanshyam Das Mishra Counsel for Respondent :- G.A.
Hon'ble Mrs. Sunita Agarwal,J. Hon'ble Mrs. Sadhna Rani (Thakur),J.
Heard Sri Ramesh Chandra Upadhyay, learned counsel for the petitioner, learned A.G.A. for the State and perused the impugned F.I.R. as well as material brought on record.
This petition has been filed by the petitioner with a prayer to quash the F.I.R. dated 01.06.2021 registered as case crime no.203 of 2021 under sections 147, 149, 307, 504 I.P.C. and 3(1)da 3(2) (5) SC/ST Act, police station Hariparwat, District Agra.
It is argued by the learned counsel for the petitioner that no offence is made out for involvement of the petitioner herein.
From a bare perusal of the first information report, the submission of the learned counsel for the petitioner is found misconceived as it cannot be said that no cognizance offience is made out against the petitioner.
The writ petition is found devoid of merit and is, accordingly, dismissed.
