JUDGMENT / ORDER

Court No. - 34
Case :- WRIT - A No. - 50665 of 2002 Petitioner :- Bishambhar Nath Respondent :- The Sachiv Nagar Vikas And Others Counsel for Petitioner :- P.N. Khare Counsel for Respondent :- C.S.C.,Vivekanand Srivastava
Hon'ble Sudhir Agarwal,J.
1. Called in revise. None appeared to press this writ petition. Learned Standing Counsel is present for respondents. In the circumstances, I myself have perused the record.
2. By means of present writ petition, petitioner has sought following reliefs:
“i. issue a writ, order or direction in the nature of Certiorari strucking down/quashing the impugned Government Orders dated 23.12.1997 (Annexure-4) and 31.12.1997 (Annexure-8) to this writ petition respectively.
ii. issue a writ, order or direction in the nature of mandamus commanding or directing the respondents to fix the petitioner's salary in the revised pay scale of 01.01.1996 as well as fix the pensionary benefits revised from time to time in accordance with the Government Order Nos.1720 and 1721 dated 23.12.1997 (Annexure Nos.3 and 4).
iii. issue a writ, order or direction in the nature of mandamus commanding or directing the respondent No.1 to decide the petitioner's representations dated 03.10.2001, 16.02.2002, 28.05.2002 and 05.09.2002 (Annexure Nos. 15, 16, 17 and 18, respectively) within a stipulated period.”
3. I myself have gone through the pleadings, grounds as also reliefs sought and find that petitioner is not able to make out a case so as to justify interference of this Court by granting reliefs, as prayed for.
4. Moreover, it appears that either the cause of action no more survives or the petitioner has lost interest in this matter or it has otherwise become infructuous and, probably for this reason, none is interested to have decided this matter on merits and that is why, counsel for petitioner is absent.
5. Dismissed. Interim order, if any, stands vacated.
