Supplementary Affidavit filed today is taken on the record.
Heard learned counsel for the petitioner and the learned Standing Counsel for the State respondents.
The appointment of the petitioner on the post of Urdu Translator-cum-Junior Clerk came to be brought to an end pursuant to an order dated 12 June 1995. The said order appears to have been passed on a dispute having arisen whether the qualification held by the petitioner was equivalent to Intermediate. The dispute with respect to the qualification held was ultimately resolved by the State Government in terms of its Government Order dated 19 December 2006. Pursuant to the said clarification, a fresh appointment was accorded to the petitioner on 13 April 2007.
Although, the learned counsel has sought to contend that this order was in fact one of reinstatement, the Court finds itself unable to sustain this submission in light of the plain and unambiguous language employed in the order dated 13 April 2007. Since the order was one which accorded a fresh appointment in favour of the petitioner, his claim for salary from June 1999 to March 2007 cannot be countenanced.
Writ petition lacks merit and is consequently dismissed.
