None is present on behalf of petitioner even in the revised list.
This writ petition has been filed against order dated 14.2.2001 passed by District Magistrate, Ghazipur in Case No. 62 of 1996 under Section 3(3) of U.P. Control of Goondas Act, 1970 whereby the petitioner was awarded punishment for externment of six months. Against order dated 14.2.2001 petitioner filed Appeal No. 57 of 2001 and that was also dismissed vide order dated 22.2.2005 by the Commissioner, Varanasi Mandal, Varanasi. Prayer has been made to quash both orders and/or stay the effect and operation thereof.
Since six months' period has already elapsed, hence no fruitful purpose would be served in keeping this writ petition pending. The writ petition has become infructuous. This Court also finds no illegality or infirmity to interfere with the orders impugned in this writ petition.
The writ petition is dismissed. Stay order, if any, stands vacated.
