Birendra Kumar Singh And Others vs State Of U P And Others

High Court Of Judicature at Allahabad|20 December, 2018
|

JUDGMENT / ORDER

Court No. - 34
Case :- WRIT - A No. - 48238 of 2003 Petitioner :- Birendra Kumar Singh And Others Respondent :- State Of U.P. And Others Counsel for Petitioner :- N.B. Singh,K.K. Roy Counsel for Respondent :- C.S.C.
Hon'ble Sudhir Agarwal,J.
1. Called in revise. None appeared to press this writ petition. Learned Standing Counsel is present for respondents. In the circumstances, I myself have perused the record.
2. By means of present writ petition, petitioners have sought following reliefs:
“(i) issue a writ, order or direction in the nature of certiorari quashing the order dated 26.7.2003 (Annexure No. 2 to the writ petition) passed by the respondent no. 2.
(ii) issue a writ, order or direction in the nature of mandamus commanding the respondents to regularise the petitioner's services from the date of their initial appointment i.e. on 7.4.1998.
(iii) issue a writ, order or direction in the nature of mandamus commanding the respondents to grant selection grade to the petitioners after completion of the 8 years continuous service from the date of their initial appointment continuing from 7.4.1988.
(iv) issue a writ, order or direction in the nature of mandamus commanding the respondent to pay the arrears of the salary with potential interest to the petitioners after conferring the selection grade to the petitioners from the year 1996, after the completion on the 8 years from the date of their initial appointment.”
3. I myself have gone through the pleadings, grounds as also reliefs sought and find that petitioners are not able to make out a case so as to justify interference of this Court by granting reliefs, as prayed for.
4. Moreover, it appears that either the cause of action no more survives or the petitioners have lost interest in this matter or it has otherwise become infructuous and, probably for this reason, none is interested to have decided this matter on merits and that is why, counsel for petitioners is absent.
5. Dismissed. Interim order, if any, stands vacated.
Order Date :- 20.12.2018 PS
