JUDGMENT / ORDER

(Per : HONOURABLE MR.JUSTICE V. M. SAHAI) 1. We have heard Mr.Kaushik B.Pujara, learned counsel appearing for the appellant and Mr.Rakesh Patel, learned Assistant Government Pleader appearing for the respondent.
2. The grievance of the appellant is that after the order was passed by the learned Single Judge, DPC has been held and the names for promotion have been recommended to the GPSC, whereas the appellant's writ petition against adverse entry has been admitted by the learned Single Judge and the Rule has been made returnable on 5.3.2013. He prays that if the petition is not decided early, the appellant may be superseded by juniors to him. Therefore, he prays that interim relief be granted. We are not inclined to interfere with the refusal of the interim relief by the learned Single Judge. However, it is always open to the learned Single Judge to prepone hearing of the writ petition if such an application is moved by the petitioner bringing correct facts to the notice of the learned Single Judge.
3. Subject to the observations made above, this Letters Patent Appeal is dismissed. As a consequence, Civil Application does not survive.
