Heard learned counsel for the petitioner and learned Standing Counsel and perused the record.
Present writ petition has been filed by the petitioner with the following prayer :-
"To issue a writ, order or direction in the nature of mandamus directing the respondent no.1 i.e. Deputy Director of Consolidation, Ballia to decide the case bearing Revision No.1240 Birbal Vs. Ravichandra and others, under Section 48 of U.P. consolidation of Holdings Act, 1950, pending in the Court of Deputy Director of Consolidation, Ballia since 13.10.1992, within stipulated period."
It is averred in the writ petition that arising out of an allotment proceeding, present petitioner has filed a revision against the order dated 31.10.1988 passed by Settlement Officer of Consolidation, Ballia. The aforesaid revision filed before the Deputy Director of Consolidation, Ballia, (respondent No.1) is still pending since the date of filling. i.e. 13.08.1992 Learned Standing Counsel has fairly contended that he has no objection if this Court issues a direction for early disposal of the revision, which is pending disposal.
Be that as it may, no useful purpose would be served to keep this matter pending, therefore, this Court deems it appropriate to finally dispose of the present writ petition, without making any observation on the merits of the case as mentioned in the present writ petition, with a direction to Deputy Director of Consolidation, Ballia, before whom the revision (Annexure-1) is pending disposal, to decide the same expeditiously, preferably, within the period of three months from the date in receipt of certified copy of this order.
It is expected that it should be decided by reasoned and speaking order, in accordance with law, after affording opportunity of hearing to the parties concerned without granting unnecessary adjournments.
The petitioner shall file a computer generated copy of this order downloaded from the official website of High Court, Allahabad, supported by an affidavit, which shall be verified by the concerned authority from the website of the High Court, Allahabad.
With the aforesaid observations, present writ petition is disposed of.
