(Per : HONOURABLE THE ACTING CHIEF JUSTICE MR.BHASKAR BHATTACHARYA) By this application for contempt, the petitioners have alleged violation of the order dated October 18, 2010 and also the order dated April 29, 2011 by which the respondents were directed to consider the representation of the petitioners which was pending in accordance with law positively by the end of June, 2011.
It appears that this application for contempt was filed on November 22, 2011 and after issue of notice by this Court, the concerned respondent had disposed of the representation on December 21, 2011.
Since the respondents have complied with direction though belatedly, we do not propose to take any penal action against them. However, for unnecessarily harassing the petitioners, we impose costs of Rs. 1,000/- [Rupees One Thousand only] upon the respondent no.1 to be paid to the petitioners within a month from today. We make it clear that we have otherwise not gone into the merit of the decision on the representation and if the petitioners are of the view that the said decision has prejudicially affected any of their rights, they are free to challenge the same before appropriate forum in accordance with law.
The application is disposed of accordingly.
