JUDGMENT / ORDER

1. Shri K.M. Antani, learned advocate appearing for Shri Satyam Chhaya, learned advocate appearing on behalf of the applicant seeks permission to delete respondents nos. 2 and 3 so far as the present application is concerned as respondent no. 1 only can be said to be the main contesting party. Permission is accordingly granted. Respondents nos. 2 and 3 stands deleted so far as the present application is concerned.
2. The present application under Section 5 of the Limitation Act has been preferred by the applicant to condone the delay of 23 days in preferring the Civil Revision Application.
3. Having heard the learned advocates appearing on behalf of the respective parties and as the application is not seriously opposed by Shri Kakkad, learned advocate appearing on behalf of respondent no. 1, the present application is allowed and the delay caused in preferring the Civil Revision Application is hereby condoned. Rule is made absolute accordingly. No cost.
