Leave to amend By way of present application, the applicant seeks modification of condition No.7(d) of the order dated 01.08.2008 passed in Criminal Miscellaneous Application No.10149 of 2008. Condition No.7(d) reads as under:
[d] not leave the State of Gujarat without the prior permission of the Sessions Court concerned Heard Ms.Khushbu Danecha, learned counsel for the applicant and Mr.Alkesh Shah, learned Additional Public Prosecutor for respondent-State.
In view of averments made in the application, present application is allowed. The condition No.7(d) of the order dated 01.08.2008 passed in Criminal Miscellaneous Application No.10149 of 2008 is hereby modified to the extent that in place of State of Gujarat it will be India . Rule is made absolute to the aforesaid extent. Direct service is permitted.
