The writ petition was filed for a direction to the first respondent not to grant permit to the vehicles of auto-rickshaws with halting place at Kambalakkad in Wayanad District coming within the Grama Panchayat. This Court in Rajesh v. Secretary, Regional Transport Authority (2014 (3) K.L.T. 341) has, in fact, considered the above issue and clearly held that, unless there is a notification by the Government, there could be no restriction even by the Regional Transport Authority. The application for permit has to be considered on its merits individually.
In such circumstances, the prayer to restrict grant of permit of vehicles of auto-rickshaws cannot be granted. Writ petition is, hence, dismissed.
