JUDGMENT / ORDER

Conviction and sentence under Section 138 of the Negotiable Instruments Act are under challenge in this revision. When the original complainant died pending the proceedings, his legal representative was brought on party array as additional respondent. Pending the proceedings, the accused and the legal representative of the complainant settled the matter amicably out of court and compounded the offence. The composition was accepted and permission for composition was granted on Crl.M.A No.4123 of 2014. In the above circumstances, the conviction and sentence against the revision petitioner under Section 138 of the Negotiable Instruments Act in C.C No.44 of 2002 of the Judicial First Class Magistrate Court-II (Mobile), Kottayam are set aside and the revision petitioner is released from prosecution on the benefit of acquittal under Section 320 (8) of Cr.P.C. The bail bond executed by the revision petitioner will stand discharged. The revision petition is allowed as above.
