JUDGMENT / ORDER

Petitioner is 2nd accused in Crime No.786 of 2014 of the Pathanamthitta Police Station for the offences punishable under Sections 294(b), 323 and 326 read with Sec.34 of the Indian Penal Code, apprehends arrest and has filed this application. 2. Learned Public Prosecutor has opposed the application.
It is submitted that on 02.05.2014 at the relevant time petitioner and others attacked the de facto complainant who is a security guard of the ATM counter of the Bank of India.
3. Learned counsel submits that the allegations are not true.
4. Having regard to the allegations made, request for pre- arrest bail cannot be allowed.
5. It is open to the petitioner to surrender before the Officer investigating the case. In case he is arrested he shall be produced before the jurisdictional magistrate as early as possible.
Application is disposed of as above.
