Heard learned counsel for the petitioner, learned counsel appearing for respondents 1 and 2 and the learned Government Pleader.
2. This Writ Petition has been filed as a public interest litigation praying for a direction to the first respondent to complete the repairing and tarring of Kumbalam-Aroor Bridge in National Highway-49 at the earliest, within a time frame.
3. A statement has been filed on behalf of the first respondent, wherein it has been stated that the repair work has already been sanctioned and completed. The paver block work has been done. The potholes have already been filled up. However, a few large damaged areas are to be repaired. It has further been stated that for total repair of the road, administrative sanction has been received and a tender was issued fixing 17.10.2014 as the last date, but no tender was received. Again it has been re-tendered for 3.11.2014. It is WP(C).21690/14 2 submitted that in the event no one comes forward to complete the work, a decision has to be taken regarding dismantling of the entire bridge. It is submitted that the decision has to be taken by the Ministry of Surface and Transport.
4. The first respondent may consider all aspects of the matter and make recommendation to the authorities concerned for repairing or redoing of the entire bridge and after obtaining necessary sanction from the authorities concerned, the first respondent shall complete the work.
With the above observation, the Writ Petition is closed.
