JUDGMENT / ORDER

------------------- Petitioner challenges Ext.P6 certificate issued by the Tahsildar. Ext.P6 certificate had been issued proclaiming that certain persons are legal heirs of the deceased Ayyappan. According to the petitioner, though objection was filed before the Tahsildar without taking into account their rights, Ext.P6 had been issued. While impugning Ext.P6, the question to be considered regarding the persons who are to be the legal heirs of late Ayyappan. This question can be decided only in a civil suit especially when there is dispute as evident from the contentions urged by the parties in Ext.P6. One group claims to be legal heirs and another group claims that they are also the legal heirs. Such issue can be adjudicated only in a proper civil suit and it shall always be open for the petitioner to challenge Ext.P6 in the said proceedings.
W.P.C.No.14440 OF 2014
2
In the result, I do not interfere with Ext.P6 at this stage. Accordingly this writ petition is dismissed reserving liberty to the petitioner to approach the civil court for appropriate orders.
