The prayer made in the instant petition is for issuing direction to the court below to decide Misc. Case No. 101 of 2018 (Old Misc. Case No. 24 of 2010), within a specified time frame.
The said case has been registered on basis of application filed by the plaintiff-respondents for preparation of a final decree in partition suit.
According to the learned counsel for the petitioner a second appeal was filed before this Court challenging the preliminary decree and the judgment passed in first appeal. The second appeal is still pending but there is no stay.
Having regard to the above facts, the instant petition is disposed of with direction to the court below to decide the Misc. Case No. 101 of 2018 expeditiously, provided there is no legal impediment.
