Heard Sri Rahul Jain, learned counsel for the plaintiff- landlord/petitioner.
The only relief pressed by learned counsel for the petitioner in this petition is that P.A. Case No.5 of 2014 (Bimal Kumar Jain Vs. Praveen Kumar Yadav) pending before the Prescribed Authority, may be directed to be decided within a time bound period.
Learned counsel for the plaintiff-landlord/petitioner submits that expeditious disposal of rent cases is a statutory mandate as also reflected from Rule 15(3) of the U.P. Urban Buildings (Regulation of Letting, Rent and Eviction) Rules 1972. The aforesaid P.A. Case is not being decided although about 4 years have passed.
Considering the facts and circumstances of the case, this petition is disposed of providing that the concerned court below shall decide the aforesaid P.A. Case, in accordance with law, expeditiously, preferably within six months from the date of presentation of a certified copy of this order, without granting any unnecessary adjournment to either of the parties.
