Heard learned counsel for the petitioner; learned A.G.A. for the State-respondent nos.1, 2 and 3; and perused the record.
The instant petition is by the informant seeking a direction upon the respondent no.3 to carry out fair investigation of Case Crime No.1345 of 2018, under Sections 363, 366 I.P.C. and 7/8 POCSO Act, Police Station Baraut, District Baghpat.
On 22.01.2019, we had required the learned A.G.A. to seek instructions as regards the efforts made by the Investigating Officer.
On 07.02.2019, we had granted further time to the learned A.G.A. to seek instructions and had required the Investigating Officer of the case to be personally present before the Court in person.
Today, the Investigating Officer of the case is present before the Court.
Learned A.G.A., on the basis of papers produced before us, has made a statement that girl has been recovered and her statement has been recorded. On the basis of her statement, a final report has been submitted on 02.02.2019.
In view of the above, no further action is required in this jurisdiction. The petitioner would have liberty to submit protest petition against final report before the court concerned. If final report has not yet been submitted in the Court, the same shall be submitted within a period of three weeks from today.
The petition is disposed off.
