JUDGMENT / ORDER

Petitioner has approached this Court seeking the following reliefs: “i. Issue a writ in the nature of of mandamus or such other writ, direction or order directing the Consumer Disputes Redressal Forum, Palakkad to give an opportunity to the petitioner the pay the amount in Ext. P1 execution application in 15 equal monthly instalments;
ii. Issue a writ of mandamus or such other writ, direction or order directing the Consumer Disputes Redressal Forum, Palakkad to keep in abeyance all further proceedings on Ext. P1 till the petitioner pays the amount in instalments within the time to be fixed by this Honourable Court.”
2. Petitioner seeks for time in paying the award amount in terms of Ext. P1 execution application.
3. Admittedly, this is a matter pending before the Consumer Disputes Redressal Forum. The petitioner is called upon to appear before the Forum on the basis of an execution petition filed by the decree holder. There is no reason to interfere with reference to a proceeding for execution pending before the Consumer Disputes Redressal Forum. Hence, I do not think that this Court should pass any order as claimed by the petitioner. It is always open for W.P(C) No. 10928 of 2014 -: 2 :-
the petitioner to approach the Forum and seek appropriate instalment facility. As matters stand now, only bailable warrant has been issued. The petitioner can as well approach before the Forum and seek appropriate instalments.
4. Hence, I do not find any merit in this writ petition and accordingly the same is dismissed.
The Forum shall permit the 1st respondent to withdraw the amount deposited by the petitioner before the Forum by virtue of the interim order passed by this Court.
