By means of the present petition, the petitioners herein are seeking for quashing of the first information report dated 20.06.2021 registered as Case Crime No.0272 of 2021, under Sections 147, 148, 149, 323, 324, 307, 504 IPC P.S.- Mawana, District-Meerut.
It is contended by the learned counsel for the petitioner that with regard to the incident occurred on 19.06.2021, two first information reports had been lodged on account of which the petitioners are facing inconvenience.
A perusal of the record indicates that the first information report dated 19.6.2021 had been lodged against eight persons who had indulged in an altercation which had resulted in disturbance of law and order situation. The report lodged by the police was in order to report the incident.
As regards the first information report dated 20.06.2021, it seems that the first informant/respondent no.3 had given his own version of the incident. Learned Advocate for the respondent no.3 submits that the injuries had been caused to the side of the complainant.
Be that as it may, the version in the two first information reports are about one incident which occurred on 19.6.2021. It would, therefore, be proper for the investigating officer to make investigation in both the matters together.
In any case, as the occurrence of the incident is not in dispute, it is not possible for us to ascertain as to who was the aggressor of the crime and whether the petitioners herein are innocent.
With the above observations that the investigating officer has to proceed the investigation in both the criminal case together so that there may not be any multiplicity of the proceedings, we dismiss the present petition as we do not find it a fit case for interference.
