JUDGMENT / ORDER

The petitioners have made an application for transfer of the regular permit at Ext.P2, existing in the name of the 1st petitioner, to the 2nd petitioner. The transfer applied for by Ext.P2 is not seen effected purportedly, for reason of a tax liability; pending against the vehicle. The demand made on that count is pending in revision, wherein there is a stay granted as per Ext.P6. The 2nd respondent, who has filed an affidavit in the above original petition on behalf of the 1st petitioner also, undertakes before this Court that he would take up the liability, if at all the revision goes against the revision petitioner. It is also to be noticed that the liability would any way remain on the vehicle and the department could always proceed against the vehicle also for recovery. 2. Taking all the above circumstances into W.P.(C) No.26650 of 2014 - E 2 consideration, the 2nd petitioner is directed to file an indemnity bond indemnifying the liability, if the same is found against; in the revision and on such indemnity bond being filed, the transfer application shall be considered in accordance with law within a period of two weeks from the date of production of the indemnity bond. The application shall be allowed provided there is no other legal impediment.
The writ petition is disposed of.
