The petitioner's Excavator (JCB) bearing registration No.KL-40-C-7279 has been seized alleging offence under the provisions of Mines and Mineral (Regulations and Development) Act, 1957 by the first respondent while leveling a land. The petitioner submits that this vehicle has been involved only for leveling of agricultural land. Considering the facts and circumstances there shall be a direction to the first respondent to release the vehicle to the petitioner on executing a simple bond with two sureties. However, this will not stand in the way of respondents in filing a complaint against the petitioner, if so warranted, to proceed against the petitioner, in accordance with law.
Writ petition is disposed of as above.
