Petitioner is the accused in Crime No.207 of 2014 of the Mangalam Dam Police Station for the offences punishable under Sections 8(1) and 8(2) of the Kerala Abkari Act for alleged possession and sale of illicit arrack on 18.03.2014 at about 5.30 p.m., apprehends arrest and has filed the application. 2. Learned Public Prosecutor has opposed the application.
It is submitted that getting information about unauthorised sale of illicit arrack, the police reached the place of occurrence and thereon, the petitioner ran away from the scene leaving the contraband. Petitioner is also involved in Crime No.537 of 2012 of the same station for similar offence.
3. Learned counsel submits that it is a case of mistaken identity.

4. Having regard to the nature of allegations made and investigation required to be done, request for pre-arrest bail cannot be allowed.
The application is dismissed.
