The only prayer in this writ petition is to issue fitness certificate to the petitioner's contract carriage bearing registration No.KL-02-AG- 2133 without insisting for payment of difference in tax as applicable to contract carriages having push back seats. However, it is necessary to have an inspection by the competent authority to allow the prayer in the writ petition. The petitioner limits his prayer for a direction to the respondent to inspect his vehicle and find out whether the said vehicle is having push back or rigid seats.

Therefore, this writ petition is disposed of directing the respondent to inspect the petitioner's vehicle to find out the correctness of the seats and, after completing the inspection and on satisfaction of the claim of the petitioner, the authority shall levy tax and issue certificate of fitness in accordance with the finding of such inspection.
