JUDGMENT / ORDER

Petitioner is the 4th accused in Crime No.134 of 2014 of the Thumba Police station for the offences punishable under Secs.341, 323, 324, 427 and 307 read with Sec.34 of the Indian Penal Code, apprehends arrest and has filed the application. 2. Learned Public Prosecutor has opposed the application. It is submitted that on 09.02.2014 at about 2.30 p.m., on account of political rivalry the petitioner and others who came riding motorcycles attacked the defacto complainant with iron pipe and iron rod and inflicted injuries on them. The motorcycle of the defacto complainant was damaged.
3. Learned counsel submitted that the allegations are not true. It is submitted that accused nos.1 and 2 are arrested and released on bail.
4. The incident occurred allegedly due to political rivalry. In cases of this nature which affects Bail Appl. No.2899 of 2014 2 public tranquility, lenient view cannot be taken. Having regard to the facts of the case, I am inclined to think that request for pre arrest bail cannot be allowed.
5. It is directed that in case the petitioner is arrested, he shall be produced before the jurisdictional magistrate as early as possible.
The application is disposed of with the above direction.
