Order:
This Writ Petition is filed for a Mandamus to declare the inaction of respondent No.2, in passing order on the stay application, pending the appeal filed by the petitioner against the proceeding in R.C.F/2408/2014, dated 30-08- 2014, of respondent No.3, as illegal and arbitrary.
In obedience to the notice issued by this Court, respondent No.2 is personally present and he has stated that he has disposed of the stay application filed by the petitioner on 11.11.2014. However, this Court has found certain shortcomings in the order passed by respondent No.2, in particular, in dealing with the petitioner’s plea that he has handed over all the 45 coupons to respondent No.3. Respondent No.2 has assured that he will carefully examine the appeal pending before him and pass a final order by recording detailed reasons.
In view of this undertaking given by respondent No.2, the Writ Petition is disposed of with the direction to him to dispose of the appeal, on merits, after considering the case of the petitioner and examining the records in detail, within three weeks from today. Till disposal of such appeal, the petitioner shall be continued as the fair price shop dealer.
As a sequel, WPMP.No.41798 of 2014, filed by the petitioner for interim relief, is disposed of as infructuous.
