JUDGMENT / ORDER

The petitioner approached this court seeking a direction to the Government to notify the authority to grant permission under Rule 57(1) of Kerala Minor Mineral Concession Rules.
2. Considering the fact that Government has not appointed any person under Rule 57(1) of Kerala Minor Mineral Concession Rules to consider the application, there shall be a direction to the Government to take immediate steps to notify the authority to consider the application under Rule 57(1) of Kerala Minor Mineral Concession Rules. It shall be done within a period of two months.
3. In view of the non appointing of authority, the application filed by the petitioner before the Revenue Divisional Officer by Ext.P3 shall be considered by Revenue W.P.(C) No. 31830/2014 -2-
Divisional Officer under Rule 57(1) of Kerala Minor Mineral Concession Rules; as the petitioner’s case is that he requires land for agricultural purpose. Needful shall be done by the Revenue Divisional Officer within two weeks. If the R.D.O. grants permission, he shall impose such conditions to ensure that no earth is extracted for transportation outside the property.
