Petitioner had prized two chitties offered by the Kerala State Financial Enterprises Ltd. (KSFE). It is the case of the petitioner that though he had offered sufficient security for releasing the prized amount covered by the chitties, the 2nd respondent has not released the chitty amount on the ground that petitioner's husband owes certain amount to the respondents.
2. A statement is filed by the respondents inter alia stating that the security furnished by the petitioner was not proper as the property involved had no access. Hence, unless proper security is furnished by the petitioner, it may not be possible for them to release the chitty amount.
Having regard to these factual situation, this writ petition is disposed of as under:
W.P.C.No.1721/2014 2
i) Petitioner shall furnish adequate security for the prized amount covered by the two chitties to the satisfaction of the 2nd respondent and on receipt of the same, 2nd respondent shall release the amount to the petitioner.
ii) The entire process shall be completed within a period of one month from the date of receipt of a copy of this judgment.
