In the first call, Shri Dhirendra Bahadur Singh, learned counsel for the petitioner in Writ - C No. - 18104 of 2021 states that he does not want to press the writ petition. However, the matter was directed to be taken up in the revised call as Shri Faizur Rahman, learned counsel for the petitioner in the connected Writ - C No. - 32776 of 2019 was not present.
None appears on behalf of the petitioner (in both petitions) in the revised call whereas Shri Alok Mishra and Shri Baleshwar Chaturvedi, learned counsel for the respondent corporation (in both petitions) are present.
Writ - C No. - 18104 of 2021 has been filed by Bijendra Singh, supported by the declaration made by Shri Dhirendra Bahadur Singh, learned counsel for the petitioner. It is clearly stated that this is a first writ petition filed by the petitioner and no other petition has been filed for the same cause of action.
Learned counsel for the respondent corporation pointed out that earlier, the same petitioner had filed Writ - C No. 32776 of 2019, which was supported by the affidavit of Vijendra Singh, dated 14.08.2019. That writ petition is still pending.
Clearly, the second writ petition has been filed by concealing material facts. The petitioner has came with unclean hands.
We are not inclined to entertain either of these petitions owing to the conduct offered by the petitioner. Accordingly, both the writ petitions are dismissed with cost of Rs. 10,000/- on the petitioner to be paid before the High Court Legal Services Committee, Allahabad, within a period of one week from today.
