List has been revised. No one appears for the petitioner.
This is a writ petition of the year 2009. The petitioner is seeking a direction to the respondents to take immediate action in respect of the petitioner, other labourers and their families.
On 17.12.2009, this Court had directed the District Magistrate, Baghpat to conduct an enquiry into the matter either himself or through a responsible officer and submit the report to the Court within two weeks.
A compliance affidavit has been filed by the then District Magistrate, Baghpat in which it is stated that an enquiry was got conducted by him and during the enquiry the statement of the Brick Kiln owner was recorded and the statement of the labourers, who were working on the Brick Kiln, other than the petitioner were also recorded on the spot on 14.1.2010. The report also mentions that the petitioner Bijendra and the other aggrieved persons namely Sh. Mahavir, Sushil, Birsen, Ravindra, Munni, Bisani, Chaman, Davendra, Anita, Maheka, Munni, Rahul, Mahak Singh, Priti, Raj Singh, Rajesh, Bala, Sanjeev, Jagpal, Mahendra, Kanti, Rishipal, Satish along with their 41 children and cattle were not found on the spot and it was reported that they had gone to their villages. In the report, it is clearly stated that neither the petitioner nor any of his companions were found to be bonded labour of the respondent no.5.
No rejoinder affidavit has been filed, although copy of the compliance affidavit was served upon the learned counsel for the petitioner on 21.1.2010.
We therefore, dismiss this writ petition being frivolous and without merit.
