Petitioners are accused nos.3, 4 and 7 in Crime No.554 of 2014 of the Vadakara Police station for the offences punishable under Secs.143, 147, 148, 323, 324 and 308 read with Sec.149 of the Indian Penal Code, apprehend arrest and have filed the application. 2. Learned Public Prosecutor has opposed the application. It is submitted that on 05.05.2014 at about 7.45 p.m., the petitioners and others attacked the defacto complainant and others with iron pipe, iron hook and stick and inflicted injuries in an attempt to cause their death. It is submitted that the iron hook and stick are yet to be recovered.
3. Learned counsel has submitted that the defacto complainant is a gang leader and attacked the 1st petitioner and others for which the Police have registered Crime No.559 of 2014.
4. In the nature of the allegations made against the petitioners and investigation required to be done, Bail Appl. No.3328 of 2014 2 request for pre arrest bail cannot be allowed.
5. It is directed that incase the petitioners are arrested, they shall be produced before the jurisdictional magistrate as early as possible.
The application is disposed of as above.
