M/S Shri Bihariji Eent Udyog vs Union Of India Thru Secy Environment And Others

High Court Of Judicature at Allahabad|30 November, 2018

JUDGMENT / ORDER

Court No. - 21
Case :- WRIT - C No. - 64110 of 2008 Petitioner :- M/S Shri Bihariji Eent Udyog Respondent :- Union Of India Thru Secy. Environment And Others Counsel for Petitioner :- Anurag Shukla Counsel for Respondent :- C.S.C.,Asgi 2008/2591,P.C. Shukla
Hon'ble Pradeep Kumar Singh Baghel,J. Hon'ble Prakash Padia,J.
The petitioner has preferred this writ petition for issuance of writ of certiorary quashing the notification dated 14.09.1999 and 27.08.2003 issued by the Government of India. A further prayer has been sought for restraining the respondents for interfering in the manufacture of brick kiln by the petitioner in the traditional form.
List is revised. No one is present to press this writ petition. From the order sheet it is evident that lying dormant for several years the petitioner has not taken any step for hearing of this matter.
From the material on record, we are satisfied that no interference is called for. As the Supreme Court has passed several orders in respect of the brick kilns and in pursuance thereof the State Government has issued various Government Orders from time to time.
In addition of the above, we feel that the petitioner has lost the interest in pursuing the matter or cause of action does not survive.
Accordingly, the writ petition stands dismissed leaving it open to the petitioner to move a recall application if the cause of action still survives or this order causes any prejudice to his interest.
