Issue of inter-se seniority between the petitioner and respondent no.5 appears to be pending before respondent no.3, in which the concerned persons were required to appear with evidence on 28.6.2018. Submission is that though petitioner had appeared on the date fixed but the issue has not been determined so far.
Various arguments are advanced in order to contend that petitioner is senior to respondent no.5.
Considering the nature of order proposed to be passed, notices need not be issued to respondent no.5, and the writ petition is disposed of finally, after hearing counsel for the petitioner and the learned Standing Counsel.
As the issue of inter-se seniority is pending before respondent no.3, it would be appropriate to dispose of this petition with a direction upon the authority concerned to take an appropriate decision in the matter, after affording an opportunity of hearing to respondent no.5 and the petitioner, by passing a reasoned order, within a period of three months from the date of presentation of certified copy of this order.
