The petitioner claims to be working to the post of Peon in Nagar Nigam, Varanasi as on date. The contention of the petitioner is that he is entitled for benefit of ACP scheme floated in Nagar Nigam and making representation since 1992 but nothing has been done so far.
Be that as it may, considering the prayer of the petitioner, this Court is of the view that the claim of the petitioner for grant of benefits of ACP scheme is to be considered at the ends of respondent no.2 at first instance.
In view thereof, without expressing any opinion as to the merits of claim of the petitioner, the present petition is being disposed of with the direction to respondent no.2, Municipal Commissioner (Nagar Ayukt), Nagar Nigam, District Varanasi to consider the claim of the petitioner by passing reasoned and speaking order in accordance with law, preferably, within a period of six weeks from the date of submission of the certified copy of this order.
