The present writ petition has been filed challenging the order dated 28.11.2020 passed by the Deputy Director of Consolidation, Mahoba setting-aside the order passed by the Settlement Officer of Consolidation and restoring the order passed by the Consolidation Officer.
A reading of the order passed by the Deputy Director of Consolidation reveals that the petitioner has been allotted a chak on his original holding. It is also evident from a reading of the order dated 30.8.2017 passed by the Settlement Officer of Consolidation that the Consolidation Oficer had allotted the petitioner a chak on his original holding but the petitioner was not satisfied regarding the shape of the chak.
The order passed by the Deputy Director of Consolidation does not violate any of the principles enumerated in Section 19 of the Uttar Pradesh Consolidation of Holdings Act, 1953. The matter relates to allotment of chak and there can be no allotment of chak which would fully satisfy all the tenure holders of the village.
There is no illegality or jurisdictional error in the order passed by the Deputy Director of Consolidation so as to occasion interference by this Court under Article 226 of the Constitution of India.
The writ petition is dismissed.
