JUDGMENT / ORDER

Applicant-Bhuvendra Kumar seeks bail in S.T. No.547 of 2007 in Case Crime No. 18 of 2005 under Sections 147, 148, 149, 307 I.P.C. and 7 Criminal Law Amendment Act, Police Station Bichhuwa, District Mainpuri. Heard learned counsel for the applicant, learned AGA for the State and perused the material placed on record.
It is contended by learned counsel for the applicant that the applicant was released on bail in Session Trial No.547 of 2007 arising out of case crime No. 18 of 2005, Police Station Bichhuwa, district Mainpuri earlier but became of his mother is suffering from cancer he remains busy in her treatment, hence he could not appear before the trial court and his bail was cancelled and process were issued for ensuring and securing his presence. He further submitted that the applicant is a student and his mother is lying on the death bed and there is no one to take care of her thus, he may be released on bail. The points pertaining to nature of accusation, severity of punishment, reasonable apprehension of tampering the witnesses, prima facie, satisfaction regarding proposed evidence and genuineness of the prosecution case were dully considered.
Taking note of the submissions made by the counsel for the parties and also going through the nature of the case against the applicant, let the applicant- Bhuvendra Kumar involved in aforesaid crime be released on bail on his furnishing a personal bond of Rs. 30,000/- and two sureties each in the like amount to the satisfaction of the court concerned and executing an undertaking in the following terms:
1. The applicant shall appear on every date before the trial court and shall not seek unnecessary adjournment.
2. The applicant shall not tamper with evidence in any manner.
3. The applicant shall report to the court of C.J.M. Concerned in the first week of each month till the conclusion of the trial to show his good conduct and behaviour. In default of any of the aforesaid conditions, the bail granted to the applicant shall be deemed to be canceled and he shall be taken into custody by the court concerned.
