HON’BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION No.2792 of 2009 ORDER:
Heard the learned counsel for the petitioner and the learned Assistant Government Pleader for the respondents.
2. The petitioner is the proprietor of Indane Gas Agency, Vemulawada, Karimnagar district. The petitioner was supplying gas cylinders to the existing customers and also giving new connections to the customers as per the procedure laid down by the Indane Oil Corporation. While so, the Assistant Supply Officer, Sircilla, visited the gas agency on 23.12.2008 and verified the books of accounts and noticed shortage of 378 cylinders of 14.2 kgs and 4 full cylinders and two empty cylinders of 19.0 kgs. The 3rd respondent conducted panchanama and reported the matter to the 1st respondent for initiation of proceedings under the provisions of A.P. Petroleum Products (LRS) Order, 1980. The 1st respondent suspended the licence of the petitioner by proceedings dated 17.12.2008 under clause 28(2) of A.P. Petroleum Products (LRS) Order, 1980. Challenging the said suspension, the present writ petition was filed.
3. This Court by interim order dated 13.02.2009 granted suspension of the said order.
4. Obviously, the proceedings are pending before the 1st respondent under the provisions of the A.P. Petroleum Products (LRS) Order, 1980 and the licence of the petitioner was suspended pending enquiry. Learned Assistant Government Pleader states that the proceedings before the 1st respondent were not disposed of in view of the pendency of the writ petition.

In the circumstances, the 1st respondent is directed to complete the enquiry and dispose of the proceedings against the petitioner, within a period of three months from the date of receipt of a copy of this order and the interim suspension granted by this Court on 13.02.2009 shall continue till the disposal of the proceedings before the 1st respondent.
6. The writ petition is accordingly disposed of. Pending miscellaneous petitions in this writ petition, if any, shall stand dismissed in consequence. No order as to costs.
