JUDGMENT / ORDER

Hon'ble Alok Mathur,J.
Heard learned counsel for the petitioner, learned A.G.A. and perused the record.
By means of this writ petition, the petitioner has prayed for quashing the impugned First Information Report dated 10.11.2020 registered in Case Crime No.342/2020, in offence under Section 2 & 3 of U.P. Gangsters and Anti Social Activities (Prevention) Act, 1986 police station Rampur Mathura, District Sitapur.
It is submitted that the F.I.R. has been lodged simply to harass the petitioner and with an oblique motive and purpose. There is only one criminal case against the petitioner in which he has already been granted bail. In this regard, reliance has been placed on the averments made in para No.9 of the writ petition.
In view of the facts and material available on record and after hearing learned counsel for the parties, the writ petition is disposed of with the observations that till filing of the police report under Section 173 (2) Cr.P.C. or till credible evidence is found, whichever is earlier, the petitioner shall not be arrested in connection with the aforesaid F.I.R. The petitioner undertakes to co-operate with the investigation.
