Supplementary affidavit, filed today, is taken on record.
The applicants, by means of this application under Section 482 Cr.P.C., have invoked the inherent jurisdiction of this Court with prayer to quash the entire proceeding of Criminal Case No. 1272 of 2016 (State Versus Bhuri Devi and others), pending in the court of Chief Judicial Magistrate, Firozabad (arising out of Case Crime No. 615 of 2014), under Sections 420, 467, 468, 471 I.P.C., Police Station South, District Firozabad and charge sheet dated 08.09.2015 as well as cognizance order dated 22.04.2016.
Parties have entered in compromise. The same has been filed before trial court and it was duly verified by trial court. Certified copy of the order of verification regarding voluntarily entering in compromise has been filed as supplementary affidavit. As civil dispute in between has been finally decided on the basis of alleged compromise and this criminal proceeding has been compromised by parties, hence in view of law propounded by apex court in Gian Singh Vs. State of Punjab (2012) 10 SCC 303, nothing remains for adjudication.
Accordingly, compromise is being accepted.
The entire proceeding of Criminal Case No. 1272 of 2016 (State Versus Bhuri Devi and others), pending in the court of Chief Judicial Magistrate, Firozabad (arising out of Case Crime No. 615 of 2014), under Sections 420, 467, 468, 471 I.P.C., Police Station South, District Firozabad and charge sheet dated 08.09.2015 as well as cognizance order dated 22.04.2016 is hereby quashed.
