Heard learned counsel for the applicant, learned AGA for the State and perused the record.
This anticipatory bail application has been filed by the applicant-Bhurahan in Case Crime No. 168 of 2018 under Sections 419, 420, 467, 468, 471, 34 I.P.C. read with Section 8/22 N.D.P.S. Act, Police Station Sayyad Raja, District Chandauli.
Learned A.G.A. has pointed out that offence in which the anticipatory bail has been sought by the applicant, also includes the offence under N.D.P.S. Act and according to Section 438 (6) Cr.P.C. anticipatory bail is barred under the provision of N.D.P.S. hence filing of the instant anticipatory bail application is not maintainable.
In view of aforesaid submission, the instant anticipatory bail application is dismissed.
