This application has been filed under Seciton 482 Cr.P.C. to quash the entire proceeding of Case No. 388 of 2019, (State vs. Bhura @ Mahboob & Others), Case Crime No. 0546 of 2018, under Sections 147, 452, 323, 504, 336 IPC, Police Station Tanda, District Rampur pending in the court of C.J.M., Rampur including charge sheet dated 26.9.2018 as well as order dated 3.1.2019 passed by Chief Judicial Magistrate, Rampur.
Heard Sri Sheeba Rizvi, learned counsel for the applicants and learned AGA for the State.
At the very outset without going into the merits of the case, learned counsel for the applicants prayed that the applicants are ready to surrender before the lower court, as such, a suitable direction may be given for expeditious disposal of their bail application.
Learned AGA has no objection with the arguments contended by the learned counsel for the applicants.
In view of the above, the prayer made by the learned counsel for the applicants to quash the proceedings of Case No. 388 of 2019, (State vs. Bhura @ Mahboob & Others), Case Crime No. 0546 of 2018, under Sections 147, 452, 323, 504, 336 IPC, Police Station Tanda, District Rampur pending in the court of C.J.M., Rampur including charge sheet dated 26.9.2018 as well as order dated 3.1.2019 passed by Chief Judicial Magistrate, Rampur is hereby refused.
However, it is provided that if the applicants appear or surrender before the Court concerned within thirty days from today and apply for bail in the aforesaid case, their prayer for bail shall be considered as expeditiously as possible by the court below in accordance with law.
With aforesaid direction /observation, the instant application stands disposed of.
